Damages in IP Law
How to claim and award damages in IP? The issue of damages in IP has become partially detached from the general doctrines of law of damages both through IP legislation and case law. EU law plays an increasingly bigger role in determining the outcomes for example through the IPR Enforcement Directive and the case law of the ECJ. Forum shopping, in turn, enables optimisation of damages claims, especially as concerns patents and internationally operating businesses.
The seminar discusses the issue of damages in IP from multiple perspectives. It is useful for advocates, legal counsels of companies, other practitioners and academics alike.
