Off Label Innovation and IPR in Pharma

Speaker:

David A. Simon is the Frank H. Marks Intellectual Property Fellow & Visiting Associate Professor of Law at The George Washington University Law School and a Fellow at the Hanken School of Economics in Helsinki, Finland. From 2019-2020, he was a Visiting Assistant Professor at the University of Kansas School of Law. His scholarship–which focuses on health, intellectual property, innovation, and torts–has appeared in a variety of legal publications, including the Boston College Law Review, the Florida Law Review, the Washington Law Review, the William & Mary Law Review, and the Yale Journal of Law & Technology.

In private practice, David represented clients in corporate, real estate, and intellectual property transactions. His clients included hedge fund managers, investment firms, small businesses, professional athletes, homeless veterans, singers, songwriters, and artists. He also served as a volunteer attorney for Lawyers for the Creative Arts.

David holds an LL.M. from Harvard Law School, where he was a Summer Academic Fellow, and a Ph.D. from the University of Cambridge, where he was a Cambridge International Scholar (full tuition scholarship & stipend) and member of Trinity College. His dissertation examined the philosophical underpinnings of so-called authors’ rights (droit moral) in copyright law. He earned his B.A., with high honors, from the University of Michigan, and his J.D., with high honors, from Chicago-Kent College of Law, where he was selected to the Moot Court Honor Society, Order of the Coif, and Dean’s List. During law school, he won several writing awards for work in constitutional law and intellectual property law.

Post-Doctoral Researcher Dhanay Cadillo Chandler, University or Turku

Dhanay Cadillo Chandler is a Visiting Professor at LUISS University, School of Law, Rome-Italy; and a Post-Doctoral Researcher at the University of Turku (UTU), Faculty of Law, Turku-Finland. In her current role at LUISS, her tasks involve research and teaching both Master and PhD students about bioeconomy, innovation, orphan drugs and pharma regulation in the EU. In her most recent publication, Dhanay explores the challenges brought upon access to COVID-19 treatment (i.e. vaccines) by the additional layers of protection found within the EU pharma & IP regulatory framework. Her ongoing research at UTU addresses the need to re-evaluate the current incentives to prompt pharmaceutical innovation while at the same time regulating new health technologies. Findings from this research have been presented at international workshops at the NYU School of Law, Franklin Pierce Center for Intellectual Property – University of New Hampshire, Texas A&M -School of Law, University of Oxford, Hanken School of Economics, and McGeorge School of Law. Her research builds on previous findings of her doctoral dissertation and subsequent research. She has been an active member of the Faculty of Law in Turku, where she has created and implemented courses at master’s and PhD level. Dhanay has comprehensive teaching experience in Finland and abroad. Additionally, her publications and research interests include human rights, corporate social responsibility, bioeconomy, sustainable development, comparative international intellectual property rights, international trade and international transactions.

Additionally, she is a Hauser Global Research Fellow alumnus, she spent the 2019-2020 academic year at NYU School of Law and was affiliated to Engelberg Center on Innovation Law & Policy. Also held a Post-Doctoral Researcher at the Turku Institute of Advanced Studies (TIAS) during the academic term 2018-2019. Dhanay is a lawyer graduated from MonteÁvila University- Venezuela. She received her Ph.D in 2014 from Hanken School of Economics and also holds a Master in Foreign Trade from Universidad Carlos III de Madrid in 2006.
