Only few issues during many decades have caused more differences of opinions and more heated debates in Nordic IP Law than the issue of equivalence in Patent Law. Equivalence is not only an issue for national patent law in the Nordic countries, but also a European one.

Article 69 EPC and the Protocol of Interpretation to Article 69 (EPC 2000) brought no radical changes to the Finnish Patents Act nor to the Patents Act in the other Nordic countries.

Article 69 have, however, brought new light on the Scope of Protection of Patents. Since we have had very few Finnish cases on equivalence so far, the relevance of the interpretation of Article 69 and the Protocol of Interpretation in other EPC Member States becomes significant for Finnish patentees, Finnish Courts of Law and Finnish Attorneys-at-Law. In this respect the Norwegian case-law on equivalence and especially the judgment Rt. 2009 p. 1055 (donepezil) by the Norwegian Supreme Court (Høyesterett) and the view of Norwegian Patent lawyers are of special interest.

The aim of this seminar is to share information of Nordic experience, especially the Norwegian develoment, but also trying to harmonize Nordic points of view on Equivalence, and to offer a basis for a further discussion between Nordic Patent Lawyers.

Are Stenvik is a former Professor of the University of Oslo, Department of Private Law . He has written his PhD thesis on patent protection and is on of the Norways’s leading authorities in the field of intellectual property law. Are Stenvik has a lot of teaching experience and he has published a great deal of scientific books and articles, especially within the fields of patent and trademark law.
